On January 6, 2026, the U.S. Food and Drug Administration issued its revised final guidance on Clinical Decision Support (CDS) software, superseding the 2022 version and closing the regulatory ambiguity that has allowed opaque AI tools to operate inside clinical workflows without accountability.

This isn’t theoretical. Across the telepharmacy landscape, AI tools are already embedded in drug interaction flagging, dosing recommendations, formulary verification, and clinical alerting. The 2026 guidance now draws a hard line: transparency is a regulatory requirement, not a design preference.

What Changed in the 2026 Guidance

The FDA’s Section 520(o)(1)(E) framework distinguishes between CDS tools that qualify as “non-device” (and therefore fall outside device regulation) and those that function as medical devices requiring premarket clearance. The contract is where the standard hardens or stays soft. Any AI vendor agreement executed or renewed after January 2026 either carries a transparency clause, with on-demand documentation of the CDS architecture, updates within 30 days of any model change, and notice of anything that affects the non-device classification basis, or it leaves the operator exposed to a model that can shift underneath them without warning.
